thanks much for the theme! my site is still a work in progress but I have made some changes, will I lose those changes when upgrading to 1.5.9?

From what I see the changes you made were hard coded into the theme, so yes you will lose them.
But as far as I see they are minor so it should be easy to get them back.
You won’t lose the custom header or the sidebar widgets.
